1. APPLICABILITY
All sales, agreements for sale, quotations, proposals, acknowledgment and contracts of sale, including but not limited to purchase orders, shall be subject to the following terms and conditions.
2. CANCELLATIONS
Orders are firm and not subject to cancellation without Image Printing's agreement. Acceptance of orders is subject to credit approval and contingencies such as fire, water, strikes, theft, vandalism, acts of God, and other causes beyond the provider's control. Canceled orders require compensation for incurred costs (including credit card processing fees) and related obligations (with minimum cancellation fee of $35).
3. NON-RETURNABLE MERCHANDISE
All merchandise covered by this invoice is a special order made expressly for BUYER. All merchandise is non-returnable unless it does not substantially conform to the quoted specifications as determined by Image Printing.
4. ARTWORK AND/OR GRAPHICS
This invoice may include a charge for producing artwork and/or graphics. Any such artwork and/or graphics is the BUYER'S property which is available to the BUYER for pick-up and use at any time. Should the BUYER not presently wish to obtain possession of their artwork and/or graphics, Image Printing will store it on our premises without charge. We will not make use of it without the BUYER'S consent. During the period that Image Printing retains possession of the BUYER'S artwork and/or graphics, Image Printing does so as a gratuitous depository, an as such, Image Printing is not responsible for any damages for any loss of the art being held for the BUYER'S convenience. Image Printing and BUYER (hereinafter THE PARTIES) are in agreement that no bailment is or will be created. Preparatory Materials: Artwork, type, plates, negatives, positives, tapes, disks, and all other items supplied by Image Printing remain the provider's exclusive property.
5. Prepress Hardcopy Proof
Image Printing will submit prepress proofs along with original copy for the customer's review and approval, if ordered by customer. Corrections will be returned to the provider on a "master set" marked "O.K.", "O.K., with Corrections", or "Revised Proof Required" and signed by the customer. Until the master set is received, no additional work will be performed. The Image Printing's will not be responsible for undetected production errors if any of the following conditions are true:
* Hard copy proofs are not ordered by the customer
* The work is printed per the customer's O.K.
* Requests for changes are communicated orally
6. Online PDF Proof
Online PDF proofs are seen by the customer on a computer monitor using a color space called RGB. RGB stands for red, green, and blue which are the primary colors of light used to display color images. RGB color may look good on a computer screen, but in certain instances very different color results may occur in the offset printing process. Full color printing by Image Printing is done on offset printing presses using the four different color process inks(known as CMYK). CMYK stands for C yan(blue), M agenta(red), Y ellow and black ( K is used so as to not cause a mix-up with blue or Cyan). Image Printing prints to a pleasing color standard through the use of standard ink densities. As a result, the Image Printing makes no warrantee that the color and image quality represented on a customer's computer monitor or ink jet or laser color printer from a PDF online proof will approximate the finished piece printed via the CMYK process of an offset printing press.
